Consignment Terms & Conditions

Thank you for choosing Custom Gun Solutions for your consignment needs. We value your trust and seek to provide the best service in the industry. By entering into a consignment agreement with Custom Gun Solutions, you agree to the following terms and conditions, which have been designed to ensure a fair, transparent, and efficient process for both consignors and buyers. It is important that you read and understand these terms before proceeding with any consignment transactions with us.

1. Eligibility for Consignment

Items accepted for consignment at Custom Gun Solutions must meet the high standards set by our team and must comply with all federal, state, and local laws. We are committed to maintaining a lawful and ethical operation, and as such, we cannot accept items that do not adhere to the legal guidelines set forth by governing authorities. Every item must be legally owned by the consignor. You must be able to provide proof of ownership and comply with any legal requirements for transferring firearms and other regulated products.

For firearms, we require that they be unloaded, in safe condition, and capable of being legally transferred. In accordance with federal firearm regulations, firearms must undergo a background check and transfer paperwork will be completed with our licensed firearm dealers. Items such as ammunition, components, and other regulated goods must also comply with applicable laws regarding the sale and transfer of such items. Custom Gun Solutions reserves the right to refuse any item deemed inappropriate, unsafe, or illegal.

2. Consignment Agreement

Before any items are accepted for consignment, a formal Consignment Agreement must be signed by the consignor and a representative of Custom Gun Solutions. This agreement will outline specific details about the consignment, including the duration of the consignment period, the agreed-upon pricing, any associated fees, and the commission that Custom Gun Solutions will charge upon the sale of the item(s).

By entering into the consignment agreement, the consignor acknowledges and agrees to all terms and conditions set forth in this document. The consignment agreement also outlines the responsibilities of both parties, including Custom Gun Solutions' duty to display and promote the items to potential buyers and the consignor’s obligation to promptly remove unsold items upon the conclusion of the consignment period.

3. Pricing and Adjustment of Prices

The pricing of consigned items will be determined by Custom Gun Solutions in consultation with the consignor. Our team will assess the condition of the item, its market demand, and its value to establish a competitive and fair price. While Custom Gun Solutions will work with the consignor to agree on a price, the final selling price is at the sole discretion of Custom Gun Solutions. In some cases, we may suggest adjustments to the price based on current market conditions or buyer interest.

If the item is not selling or if market conditions change, we reserve the right to adjust the selling price of consigned items. Price adjustments may occur at any time during the consignment period, and Custom Gun Solutions will notify the consignor of any changes. It is important to note that Custom Gun Solutions will use its professional judgment to establish pricing that is consistent with the current market demand while ensuring a fair return for the consignor.

4. Commission and Fees

Custom Gun Solutions charges a commission fee based on a percentage of the final sale price of consigned items. The standard commission rate is 15% of the total sale price. This commission fee will be deducted from the proceeds of the sale before payment is issued to the consignor. The commission fee is used to cover the costs associated with advertising, displaying, and selling consigned items, as well as operational expenses incurred by Custom Gun Solutions in managing the consignment process.

In addition to the commission fee, certain additional fees may apply to consigned items. These fees include, but are not limited to, storage fees, handling fees, transfer fees, and credit card processing fees. For example, Custom Gun Solutions will charge a 4% credit card processing fee on all sales that are paid using a credit card. This fee is deducted from the final sale amount and will be itemized on the payment statement provided to the consignor. All fees will be clearly outlined in the consignment agreement.

It is important for consignors to be aware of any potential fees associated with their consignment and to inquire about these fees before entering into an agreement. Our goal is to maintain transparency throughout the consignment process so that consignors fully understand how their sale proceeds are calculated.

5. Payment to Consignors

Once a consigned item is sold, Custom Gun Solutions will issue payment to the consignor for the sale price, minus the commission fee and any applicable fees. Payment will be made within 30 days of the sale date, depending on the agreed-upon payment method. Payments may be made via check, store credit, or bank transfer, as specified in the consignment agreement. The consignor is responsible for ensuring that payment details, such as bank account information, are accurate to avoid delays.

Consignors are encouraged to regularly check the status of their consigned items to track progress. In the event that a sale is completed and payment is processed, the consignor will be notified immediately. Should there be any issues with payment processing, consignors are encouraged to contact Custom Gun Solutions directly for assistance.

6. Duration of Consignment

The typical consignment period is 90 days. During this time, Custom Gun Solutions will display, market, and sell the consigned items in-store and through other sales channels as appropriate. If the item has not sold by the end of the consignment period, it is the responsibility of the consignor to retrieve the unsold item(s). Failure to retrieve unsold items within 10 days after the consignment period may result in additional storage fees or forfeiture of the item(s) to Custom Gun Solutions.

At the conclusion of the consignment period, Custom Gun Solutions may either return the unsold item to the consignor or extend the consignment period with the consent of the consignor. Extensions may involve adjustments to pricing or promotional efforts. Should the consignor choose not to extend the consignment period, the unsold items will be returned, and any storage fees incurred will be deducted from the consignor's proceeds.

7. Returns and Non-Sale Items

Custom Gun Solutions is not responsible for the return of any unsold items unless agreed upon in writing. If the consignor does not retrieve unsold items within the agreed-upon period, they may incur a storage fee. Any unsold items left beyond the agreed period or any unclaimed property will be subject to forfeiture or further action at the discretion of Custom Gun Solutions.

As a consignor, it is essential to check the status of your items during the consignment period and ensure you adhere to the timelines specified in the consignment agreement.

8. Liability for Consigned Goods

While Custom Gun Solutions takes great care in handling and displaying consigned items, we are not responsible for any loss, theft, damage, or other unforeseen events affecting consigned goods while in our possession. Our team takes reasonable steps to ensure that items are stored and handled in a safe and secure environment. However, Custom Gun Solutions does not offer insurance coverage for consigned items.

We strongly encourage consignors to maintain their own insurance coverage for high-value items or those that may be subject to significant risk, such as firearms and electronics. If you wish to insure your consigned items, you should contact your insurance provider to discuss available options.

9. Changes to the Consignment Agreement

Any changes to the terms of the consignment agreement must be made in writing and signed by both the consignor and a representative of Custom Gun Solutions. This includes changes to the consignment period, pricing adjustments, or any other modification to the original terms.

If a consignor wishes to remove items from consignment before the agreed-upon end date, they must request this in writing. Depending on the circumstances, a removal fee may apply.

10. Right to Refuse Items

Custom Gun Solutions reserves the right to refuse any items deemed unsuitable for consignment. This includes items that do not meet legal requirements, items that are unsafe, or items that do not align with our store's market demand. Items that are heavily damaged, out of date, or in poor condition may also be declined. Should an item be rejected for consignment, the consignor will be notified promptly, and the item may be returned or disposed of at the consignor’s request.

We hope these Consignment Terms & Conditions offer clear guidance on how to consign with Custom Gun Solutions. For any questions or further clarification on any aspect of the consignment process, please do not hesitate to reach out to our team.

Layaway & Payment Plan Terms and Conditions

Custom Gun Solutions is pleased to offer both layaway and payment plan options to help make your purchase more convenient and accessible. For layaway purchases, a 25% non-refundable deposit is required to initiate the agreement. Standard layaway contracts are valid for 90 days, unless an extension is approved by a CGS manager. The balance must be paid in full within this period. If the contract is not fulfilled within 90 days, it will be considered void, the item(s) will be returned to inventory, and all payments made—excluding the initial deposit—will be issued as store credit. No exchanges or price adjustments will be honored during the layaway period. Customers may cancel a layaway and receive a full refund of all payments if done within seven (7) days of the original deposit.

For approved payment plans, the customer must follow the agreed-upon payment schedule. A minimum monthly payment is required, and the full balance must be paid by the specified end date. Late or missed payments may result in late fees of 15% per month, suspension of purchasing privileges, cancellation of the plan, or the conversion of any funds paid into store credit, less applicable fees. Custom Gun Solutions reserves the right to cancel or modify payment arrangements for accounts that become delinquent. Returned checks are subject to a $50 fee, and accounts in default may be referred to collections. By initiating a layaway or payment plan, the customer agrees to these terms in full.

Customers are responsible for reviewing all account statements and agreements and must report any discrepancies within 10 business days. If you have any questions, our team is always happy to assist.
